New-build property,protected by law.
Buying off-plan in Luxembourg follows a precise legal framework: you only pay for what has been built, completion is guaranteed in the deed, and the building is covered for ten years after handover. Your capital moves with the construction, never ahead of it.
You pay as the building rises
Ceilings set by the Civil Code (art. 1601-9), as a share of the construction price.
- 15 %Foundations completeAt most 15 % of the construction price.
- 50 %Top slabAt most 50 % when the top slab is complete.
- 95 %Building complete95 % on completion of the building.
- 100 %Key handoverThe balance on handover — it can be held in escrow if you raise reservations.
Before works start, only the price of the land and existing elements can be requested. The exact schedule is set in the notarial deed.
Six protections, written into law
Completion or refund guarantee
The deed must provide it: the building will be finished, or the sums paid will be refunded.
Civil Code, art. 1601-5
Capped payments
Calls for funds follow the actual progress of works, within legal ceilings. You never finance construction that does not exist.
Civil Code, art. 1601-9
Owner as it is built
Rights to the land pass to you at signing; the construction becomes yours as it progresses.

FAQ
Buying off-plan,made clear.
General answers for guidance. Your notary assists you at every step.
What is a VEFA purchase?
You buy an apartment before or during construction. You become the owner as the works progress and pay in stages according to progress. The sale is signed before a notary.
Which guarantees protect the buyer?
The deed must include a completion or refund guarantee. From handover, the seller is liable for minor works for two years and for hidden defects in structural works for ten years.
When are payments due?
As the works progress, within the Civil Code ceilings (art. 1601-9): at most 15 % of the construction price at foundations, 50 % at the top slab, 95 % on completion, the balance at handover.
Can I benefit from 3 % VAT?
Possibly: the super-reduced rate applies, under conditions, to a home used as your main residence, with a benefit capped at €50,000 per home — directly after AED approval, or by refund. Check your situation with the AED or your notary.
I am buying to let: what changes?
VEFA guarantees are the same for every buyer. The tax treatment (VAT, depreciation, rental income) depends on your situation; we can put you in touch with an adviser.
What are the prices?
They are given on request, apartment by apartment, with up-to-date availability.
Does every apartment have parking?
Yes: one or two spaces depending on the apartment, in the basement, standard or WÖHR mechanised.
Are the images and plans contractual?
No. They are indicative; only the plans and specification attached to the notarial deed are binding.
